Adu boahene case: Court adjourns motion challenging prosecution’s account of evidence to thursday

The High Court in Accra has adjourned to Thursday, October 29, a motion filed by former National Signals Bureau Director General, Kwabena Adu Boahene, and two others alleging that the prosecution misrepresented evidence in its written submissions.

The motion, filed on October 19 through their lawyer, Samuel Atta Akyea, asks the court to strike out portions of the prosecution’s response to the accused persons’ submission of no case to answer, on grounds that the statements are not supported by the trial record.

The case was called on Monday, October 26.

The presiding judge, Justice John Eugene Nyante Nyadu, said the case docket was at his home and that he had only become aware of the motion that morning.

The Attorney General’s office, which was served on October 19, had not filed a formal response as of Monday.

Deputy Attorney General and Minister for Justice, Dr Justice Srem Sai, later said in a social media post that prosecutors will not file a formal response, describing the motion as frivolous.

The defence filed two separate documents. One is a reply challenging the prosecution’s legal arguments for requiring the accused to open their defence. The other is the motion now adjourned, which seeks to have specific passages expunged for allegedly misstating evidence.

In his supporting affidavit, Mr Adu Boahene identified six categories of disputed claims.

Central to the dispute are exhibits X and 11 relating to a cyber defence system purchase agreement and invoice. The defence says the prosecution claimed two witnesses, PW2 and PW4, testified that the documents were not genuine, when neither said so.

The defence also argues PW2 could not have testified on exhibit X because PW2 was discharged on April 27, 2026, while the exhibit was admitted through PW4 on June 22, 2026.

The prosecution closed its case in September after calling four witnesses.

The accused, Kwabena Adu Boahene, his wife Angela Adjei Boateng and Advantage Solutions Limited, filed a submission of no case on September 25.

Thursday’s hearing will come ahead of the court’s scheduled ruling on November 5 on whether the accused persons have a case to answer.
