The High Court in Accra has adjourned the criminal case involving former National Food Buffer Stock Company (NAFCO) Chief Executive Officer, Hanan Abdul Wahab, and his wife, Faiza Seidu Wuni, to November 19, pending further directions from the Court of Appeal.
The adjournment follows a notification by the state that the Court of Appeal had ordered a stay of proceedings while an appeal against an earlier ruling by the trial judge is being determined.
On Monday, October 19, a three-member panel of the Court of Appeal, presided over by Justice Noble Nkrumah, granted the stay after hearing arguments from lawyers for the first accused, led by former Attorney-General Godfred Dame.
The appeal arises from the High Court’s dismissal of an application by the accused persons seeking to have the charge sheet struck out on the grounds that it failed to provide sufficient particulars of the offences with which they were charged.
At Tuesday’s proceedings, October 20, trial judge Justice Francis Achibonga adjourned the matter to November 19 to allow the court to await further directions in accordance with the appellate court’s order.
The case will remain on hold pending the determination of the appeal or further directions from the Court of Appeal. The next stage of proceedings will depend on the outcome of the appellate process and the instructions issued to the trial court.
