The Republic v. Adjenim Boateng Adjei
Story by: Regina Bless
Case No.: CR/0257/2024
Court: High Court, Accra
The trial had been adjourned following a challenge by the defence to the prosecutorial authority of the Office of the Special Prosecutor (OSP), based on a High Court ruling concerning the OSP’s power to prosecute. Proceedings were paused pending the determination of the prosecution’s application for a stay of execution of that ruling while an appeal was pursued.
At the latest hearing, the prosecution informed the Court that the Supreme Court, in its judgment delivered on 29 July 2026 in Noah Tetteh Ephraim Adamtey v. Attorney-General, had affirmed the prosecutorial mandate of the OSP. The prosecution submitted that the judgment resolved the issue affecting the continuation of the trial and prayed the Court to proceed with the case. Counsel for the accused person indicated that they had no objection to the application.
Ruling of the court
Taking into account the Supreme Court’s decision on the OSP’s mandate to prosecute offences within its statutory remit, the Court ruled that the trial would continue.
The case was adjourned for the continuation of proceedings and the taking of evidence from prosecution witness six (PW6) on the following dates: 21, 22 and 23 December 2026.
